About Agricultural Development Fund

Agricultural Development Fund (ADF), is a financial institution under the Ministry of Agriculture, Irrigation and Livestock (MAIL), Government of Islamic Republic of Afghanistan (GIRoA). The ADF’s mission is to finance agriculture and agribusinesses across the country, so as to contribute to the economic development of Afghanistan. While the primary target client of the ADF is the commercial farmers, it also provides financial support to other small/large farmers, cooperatives, agricultural input suppliers, equipment dealers, processors, wholesalers and exporters; as well as to those businesses that support agriculture, such as storage facilities and the transporters. ADF provides funding to its clients both, directly and indirectly, i.e. through financial and nonfinancial intermediaries. Its financing activities span agricultural production, processing, trade and marketing at all levels. ADF offers both, conventional and Sharia compliant loan products to its clients.


About the Job


Duties & Responsibilities

  • Prepare, review and provide legal advice on all legal documents including loan agreements.
  • Court dealing, arranging execution of mortgages/collaterals and assisting the ADF in legal or other related matters.
  • Work with Credit administration department for arranging mortgages, collaterals, property documents (qabalah), and property evaluation.
  • Consult and handle ADF’s all legal processes including but not limited to credit/loans, lawsuits etc.
  • Work with the Credit team for the recovery of the default loans.
  • File legal cases in the relevant courts against the default borrowers.
  • Execute investigation and gathering factual data regarding the legal status of client’s concerned properties to protect ADF’s interest.
  • Meet with government officials, property registries, evaluators and courts to gather information on legal status of collaterals in Kabul as well as in the provinces.
  • Represent the ADF in the formal, judicial and customary legal systems.
  • Participate in judicial sessions and defends ADF’s interests in court trials.
  • Participate in the prosecution investigation process regarding the ADF’s client and employees.
  • Write and prepare the defense statement and objection over prosecution appeal in due time.
  • Prepare and file legal cases/reports on behalf of the ADF for various issues related to credit/loans, employees’ etc.
  • The legal officer is required to physically be present at minimum four hours in his duty station at ADF respective regional office.
  • The legal officer must provide a comprehensive progress report on status of the cases with the court and other activities he undertook during the week. This report should be submitted to line manager on weekend.
  • The legal officer may require to travel to Regions whenever it’s needed.
  • Other job-related tasks as assigned by the line Manager.

Job Requirements

  • University degree in Law.
  • Having at least 5 years’ experience as a Lawyer in the country.
  • Having valid license from the Afghan authorities to act as a Lawyer.
  • Having proper knowledge of Afghan Laws and juridical system.
  • Excellent negotiation and communication skills.
  • Analytical ability and serious attention to details.
  • Be able to properly communicate in local languages and English.
  • Good knowledge of computer programs such as Word, Excel etc.
  • Being flexible for travels.
